1. We respect your privacy
- Nightlight PTY LTD respects your right to privacy and is committed to
safeguarding the privacy of our customers, software application and website
users. We adhere to the National Privacy Principles established by the
Privacy Act 1988 (Cth). This policy sets out how we collect and treat
your personal information.
- Personal information means information we hold which is
identifiable as being about you.
2. Collection of personal information
- Nightlight PTY LTD will, from time to time, receive and store personal
information you enter onto our software application NightLight, provide to us
directly or give to us in other forms.
- You may provide basic information such as your name, phone number, address and
email address to enable us to send information, provide updates and process your
product or service order. We may collect additional information at other times,
including but not limited to, when you provide feedback, when you provide
information about your personal or business affairs, change your content or
email preference, respond to surveys and/or promotions, provide financial or
credit card information, or communicate with our customer support.
- Additionally, we may also collect any other information you provide while
interacting with us.
- When you choose to register or sign in using third-party authentication
services:
- For Google authentication, we collect your email address, full name, and
a unique identifier that verifies your account legitimacy.
- For Facebook or Instagram authentication, we may collect your name,
profile picture, email address (if associated with your account), date
of birth, gender, liked pages, and current location information. This
information is collected with your consent and handled in accordance
with our privacy policy and applicable privacy laws.
3. How we collect your personal information
Nightlight PTY LTD collects personal information from you in a variety of ways,
including when you interact with us electronically or in person, when you access our
software application and when we provide our services to you. We may receive
personal information from third parties. If we do, we will protect it as set out in
this Privacy Policy.
4. Use of your personal information
- Nightlight PTY LTD may use personal information collected from you to provide
you with information, updates and our services. We may also make you aware of
new and additional products, services and opportunities available to you. We may
use your personal information to improve our products and services and better
understand your needs.
- The Application may make third party social media features available to its
users. We cannot ensure the security of any information you choose to make
public in a social media feature. Also, we cannot ensure that parties who have
access to such publicly available information will respect your privacy.
- Nightlight PTY LTD may contact you by a variety of measures including, but not
limited to telephone, email, sms or mail.
5. Disclosure of your personal information
- We may disclose your personal information to any of our employees, officers,
insurers, professional advisers, agents, suppliers or subcontractors insofar as
reasonably necessary for the purposes set out in this Policy. Personal
information is only supplied to a third party when it is required for the
delivery of our services.

legal requirement, such as a law, regulation, court order, subpoena, warrant, in
the course of a legal proceeding or in response to a law enforcement agency

legal rights, property or safety of Nightlight PTY LTD, its application, website
and customers or third parties.
- Information that we collect may from time to time be stored, processed in or
transferred between parties located in countries outside of Australia.

business assets, we reserve the right to transfer to the extent permissible at
law our user databases, together with any personal information and non-personal
information contained in those databases. This information may be disclosed to a
potential purchaser under an agreement to maintain confidentiality. We would
seek to only disclose information in good faith and where required by any of the
above circumstances.
- By providing us with personal information, you consent to the terms of this
Privacy Policy and the types of disclosure covered by this Policy. Where we
disclose your personal information to third parties, we will request that the
third party follow this Policy regarding handling your personal information.

delete or anonymise your data when it is no longer needed, in accordance with
our data retention policy.

in place suitable physical, electronic and managerial procedures to safeguard
and secure information and protect it from misuse, interference, loss and
unauthorised access, modification and disclosure.
- The transmission and exchange of information is carried out at your own risk. We
cannot guarantee the security of any information that you transmit to us, or
receive from us. Although we take measures to safeguard against unauthorised
disclosures of information, we cannot assure you that personal information that
we collect will not be disclosed in a manner that is inconsistent with this
Privacy Policy.
- We implement industry-standard security measures, including encryption, access
controls, and regular security audits, to protect your personal information. In
the event of a data breach, we will notify affected users and relevant
authorities within 72 hours, as required by applicable laws.
7. Access to your personal information
- You may request details of personal information that we hold about you in
accordance with the provisions of the Privacy Act 1988(Cth). A small
administrative fee may be payable for the provision of information. If you would
like a copy of the information which we hold about you or believe that any
information we hold on you is inaccurate, out of date, incomplete, irrelevant or

- We reserve the right to refuse to provide you with information that we hold
about you, in certain circumstances set out in the Privacy Act.
- You have the right to access, rectify, erase, and port your personal
information. To exercise these rights, please contact our Privacy Officer at
admin@nightlight.com.au. We will respond to your request within 30 days, as
required by the Privacy Act and other applicable laws.
8. Complaints about privacy
If you have any complaints about our privacy practices, please feel free to send in
details of your complaints to 81-83 Campbell Street, Surry Hills, New South Wales,
2010. We take complaints very seriously and will respond shortly after receiving
written notice of your complaint.
9. Opt out right
You can stop all collection of information by the Application easily by uninstalling
the Application. You may use the standard uninstall processes as may be available as
part of your mobile device or via the mobile application marketplace or network. You
can also request to opt-out via email, at admin@nightlight.com.au.
10. Changes to Privacy Policy
Please be aware that we may change this Privacy Policy in the future. We may modify
this Policy at any time, in our sole discretion and all modifications will be
effective immediately upon our posting of the modifications on our website or notice
board. Please check back from time to time to review our Privacy Policy.
11. How Long We Retain Your Information
We keep your personal information only as long as we need it for legitimate business
purposes. However, in practice, we delete or anonymize your information upon
deletion of your account.
12. Software Application
- When you use our Application
When you come to our application we may collect certain information such as
mobile unique device ID, the IP address of your mobile device, mobile
operating system, the type of mobile internet browsers you use, and
information about the way you use the Application. This information is used
in an aggregated manner to analyse how people use our site, such that we can
improve our service.
- Cookies
We may from time to time use cookies on our software application. Cookies are
very small files which a website uses to identify you when you come back to
the application and to store details about your use of the application.
Cookies are not malicious programs that access or damage your computer,
tablet or smartphone. Most devices automatically accept cookies but you can
choose to reject cookies by changing your devise settings. However, this may
prevent you from taking full advantage of our application.

The software Application may collect certain information automatically,
including, but not limited to, the type of mobile device you use, your
mobile devices unique device ID, the IP address of your mobile device, your
mobile operating system, the type of mobile Internet browsers you use, and
information about the way you use the Application.
- Third parties
Our software application may from time to time have links to other
applications or websites not owned or controlled by us. These links are
meant for your convenience only. Links to third party applications and
websites do not constitute sponsorship or endorsement or approval of these
third parties. Please be aware that Nightlight PTY LTD is not responsible
for the privacy practises of other such applications or websites. We
encourage our users to be aware, when they leave our application or website,
to read the privacy statements of each and every application or website that
collects personal identifiable information.
- Location
NightLight would like to access your location to show users near by you on map and give you the best possible results. NightLight Used to show your current location to nearby users when you choose to share it. Location will be shared to other users till you want. You can always Disable/Delete your location data from Profile Security Screen.
13. User Generated Content

We at Nightlight PTY LTD, want to give our users the best possible experience. Hence, we
will not tolerate any abusive user or any content that is objectionable. Nudity
or any objectionable content is strictly prohibited on this application. At
Nightlight PTY LTD, users have the full right to block any abusive user.

We are committed to maintaining a safe and secure environment for all users. To
prevent the sharing of inappropriate content, our system actively detects and
restricts the upload of sexually explicit or inappropriate images.

When a user attempts to upload an image, it is automatically reviewed. If the
image contains nudity or violates our guidelines, the system will block the
upload, preventing it from being posted. This measure ensures that our platform
remains a safe space for all users.

However, if an image is initially allowed by the system mechanism but later
deemed inappropriate by users, they have the ability to report the post or the
user. Below is the process for reporting:

To report a specific post you can click the three dots near the post and select
the report option. Add a comment explaining the issue and tap on submit to send
your report.

If you wish to report a user for inappropriate content you can visit the user’s
profile page, click the three dots at the top right corner and select the report
option.
Add a comment explaining the issue and tap on submit to report the user. If a
post or user receives reports from five different users, the reported account
will be automatically flagged and suspended.

more secure environment for all users. While no system is flawless, we remain

our content moderation to uphold a positive user experience.
15. Child Safety Policy
At Nightlight PTY LTD, the safety of children is of utmost importance. We are
committed to
preventing the exploitation and abuse of children on our platform. To ensure
compliance with industry standards and legal obligations, we have implemented
the following measures:

Any content related to child sexual abuse material (CSAM) or that
violates child safety standards is strictly prohibited on our platform.
Users found engaging in such activities can be banned from the platform.

actively detects and restricts the upload of sexually explicit or
inappropriate images.

When a user attempts to upload an image, it is automatically reviewed.
If the image contains nudity or violates our guidelines, the system will
block the upload, preventing it from being posted. This measure ensures
that our platform remains a safe space for all users.

Examples include, but are not limited to:
- Child Sexual Abuse Material (CSAM)
CSAM includes still images, videos, and illustrated, computer-generated or
other forms of realistic depictions, as well as live streaming broadcasts of
a child in a sexually explicit context, or engaging in sexually explicit
acts.
- Online Grooming
Grooming broadly describes the tactics abusers use to build trust and
rapport with a child in order to gain access to that child for the purpose
of sexual activity or exploitation. This type of victimization takes place
across every platform; social media, messaging apps, gaming platforms, etc.,
and may include instances when a child is being groomed to take sexually
explicit images and/or ultimately meet face-to-face with someone for sexual
purposes, or to engage in a sexual conversation online or, in some
instances, to sell/trade the child’s sexual images.
- Minor Sexualization
Is the creation or sharing of content (including photos, videos, real-world
art, digital content, and verbal depictions) that sexualizes real or
non-real children.
- Sextortion
is a form of child sexual exploitation where children are threatened or
blackmailed, most often with the possibility of sharing with the public a
nude or sexual images of them, by a person who demands additional sexual
content, sexual activity or money from the child.
- Trafficking
Child sex trafficking is a form of child abuse that occurs when a child under
18 is advertised, solicited or exploited through a commercial sex act. A
commercial sex act is any sex act where something of value – such as money,
food, drugs or a place to stay – is given to or received by any person for
sexual activity.
- Reporting Mechanism:

If you encounter any content or activity that violates child safety
standards or our community guidelines, you can report it by clicking on
the three dots near the post and select the report option. Add a comment
explaining the issue and click on submit to report the post.

To report a user you can do so by visiting the user’s profile page.
Click the three dots at the top right corner and select report. Add a
comment explaining the issue and click on submit to report the user.
- Automated Action & Moderation

If a post or user receives five reports from different users, the
reported user’s account will be automatically suspended.

Nightlight PTY LTD reserves the right to remove content or terminate
accounts
without prior notice if they are found to violate our safety policies.
- Collaboration with Authorities
We fully cooperate with regional and national law enforcement agencies in
investigating and addressing cases of child exploitation and abuse.
